Limpopo police arrest man, 48, over the death of his 82-year-old mother in Giyani

Detectives in Giyani are also investigating whether the elderly woman was sexually assaulted, and say a rape charge may be added if the evidence supports it.

A 48-year-old Limpopo man has been arrested on a charge of murder after his 82-year-old mother was found dead at their home in Xikukwani village outside Giyani, with injuries to her head and face.

As IOL reported on 25 September, the man told police he had found his mother injured after returning from a drinking spree in the early hours of Wednesday morning. Investigators later linked him to the killing.

Limpopo police spokesperson Colonel Malesela Ledwaba said police in Giyani received a murder report at about 1am on Wednesday and went to the scene. Officers found the elderly woman lying on a bed with visible injuries to her head and face. Emergency Medical Services personnel certified her dead at the scene.

Preliminary investigations established that the woman had been living with her son, who was the person who initially reported the incident to the police.

“Police commenced with an investigation and subsequently linked the son to the murder. He was arrested and is facing a charge of murder,” Ledwaba said.

The investigation has widened beyond the murder charge. Detectives are also probing suspicions that the elderly woman may have been sexually assaulted.

“An additional charge of rape may be added should the investigation establish sufficient evidence to support such a charge,” Ledwaba said. That wording matters: no rape charge has been laid, and the suspicion remains under investigation rather than established.

The man is expected to appear before the Giyani Magistrate’s Court soon. Police said the investigation is continuing.

Limpopo Provincial Commissioner Lieutenant-General Jan Scheepers condemned the killing and called on communities to help protect vulnerable people.

“The killing of an elderly mother, allegedly at the hands of her own son, is a shocking violation of the most basic values of humanity. We condemn this heinous act in the strongest possible terms,” Scheepers said.

“The SAPS will pursue this matter relentlessly, and whoever is found responsible must face the full might of the law.”

For readers outside Limpopo, the basics of how this case will now move are worth setting out. A murder charge in South Africa is heard first in the district magistrate’s court where the alleged offence occurred, which in this instance is Giyani. The matter will typically be postponed for further investigation, and the state may add or amend charges as evidence is gathered. The rape investigation Ledwaba described is exactly that process at work, and the decision on whether a second charge is added rests with the National Prosecuting Authority on the evidence placed before it, not with the police alone.

Xikukwani is a village in the Greater Giyani area of Mopani district, a part of the province where many households are headed by older people and where adult children often live in the same home. That arrangement is ordinary, and it is also the setting in which violence against elderly relatives is most likely to go unwitnessed. The case sits inside a wider national problem: the killing of older people, most often women, at the hands of people they know. The police’s own family violence, child protection and sexual offences units, known as FCS, are the units that handle these matters, and the Giyani case is now with detectives working that beat.

Scheepers’ call for communities to protect vulnerable people is the part of the police response that speaks directly to neighbours. In practice that means reporting suspected abuse of an elderly person to the local police station or to the Department of Social Development, and it means not treating a bruise on an older relative as a private family matter.

The case has not yet been tested in court. The man has been arrested and charged, and no finding of guilt has been made. The Enquirer will report the outcome of the Giyani court appearance when it is known.
