Prosecutors have withdrawn the case against Ismail Dawood, a senior officer in Crime Intelligence, eNCA reported on Tuesday evening. He had been facing counts of assault, intimidation and extortion tied to roughly R3.5-million.

His home was searched in July while investigators were building the case, and he was later granted bail.

Dawood’s own account, as carried in that reporting, is that the matter was never connected to his police work. He described it as a civil dispute that had already been settled some years ago.

The prosecuting authority has not, in the material available, set out its reasons for pulling the charges. Whether the withdrawal is final or the matter could return to court is not established either. What is established is that a senior officer who was facing serious criminal counts no longer faces them.

For the public, the question that follows a withdrawal like this is a familiar one. A case that reaches bail, that involves a searched home and a figure of R3.5-million, and that then falls away leaves a gap between what was alleged and what was proved. Nothing in the record here says the allegations were tested in court. They were not. The counts were withdrawn before any trial.

Dawood’s profile inside the police service rests largely on his work against kidnapping, the unit for which he is most widely known. That is the work that made his name public, and it is the work that makes the collapse of a criminal case against him a matter of more than routine interest.

The prosecuting authority’s decision closes the criminal chapter for now. It does not answer the questions a reader is entitled to ask. Why were the charges brought, and why were they dropped. Who reviewed the evidence, and when. Whether the complainant was consulted before the withdrawal. None of that is in the public record carried here.

This paper will keep asking those questions of the prosecuting authority and of the police service, and will report what comes back.
