Small Claims Court limit rises to R30 000 on 1 August, first increase since 2019
Claims worth up to R30 000 can now be heard without lawyers, and the courts handled R257 million in claims last year.
The monetary jurisdiction of South Africa’s Small Claims Courts rises from R20 000 to R30 000 on 1 August 2026, the Department of Justice and Constitutional Development announced on 22 July. It is the first adjustment to the limit since 2019.
That single figure decides which forum a civil dispute can use. A claim above the prescribed amount cannot be heard in a Small Claims Court. It must go to a higher court, where legal representation is often required and litigation costs can be substantial. From 1 August, R10 000 more of everyday debt falls on the affordable side of that line.

The increase was determined in accordance with sections 15 and 16 of the Small Claims Courts Act, 1984 (Act No. 61 of 1984).
What the courts already carry
Over 36 600 cases to the value of R257 million were registered in the past financial year. In the first quarter of the current financial year, 8 825 cases were registered, totalling claims of R64 million.
There are 418 Small Claims Courts countrywide, situated at Magistrates’ Courts, and they generally sit after normal court hours. Legal representation is not required, procedures are straightforward, and litigants do not incur attorney’s fees.
The matters heard are ordinary ones. Unpaid loans where money lent was never repaid. Faulty goods bought by consumers. A homeowner suing a contractor who took payment for a service and did not complete the work. Vehicle disputes, including poor-quality repairs or damage from an accident. The courts may also hear claims for the repayment of money lent, unpaid debts, claims relating to goods, the delivery or transfer of property, certain damages, and claims arising from credit agreements, as long as the amount claimed stays within the jurisdiction.
Who sits, and how to file
Small Claims Court matters are presided over by Commissioners appointed by the Deputy Minister of Justice and Constitutional Development. The Commissioners are practising attorneys, advocates, legal academics, Legal Aid South Africa attorneys and magistrates who serve pro bono in the public interest. There are currently 1 563 Commissioners serving countrywide.
Anyone wishing to institute a claim approaches the Clerk of the nearest Small Claims Court for help in completing and serving the necessary documentation.
Deputy Minister of Justice and Constitutional Development Andries Nel said the higher limit would let more South Africans enforce their rights without costly and time-consuming litigation. He said the measure formed part of government’s broader programme to build a people-centred justice system, and that for many South Africans justice begins in the Magistrates’ Courts and the Small Claims Courts.
Access to justice is one of the cornerstones of our constitutional democracy. Small Claims Courts demonstrate that justice does not have to be expensive or complicated to be effective.
The department said further incremental increases will be considered in the near future. The change takes effect on 1 August 2026, when claims of up to R30 000 can be filed at any of the 418 courts.
