Groblersdal court remands man, 44, on two rape counts over school learners

A 44-year-old man appeared in the Groblersdal Magistrates’ Court in Limpopo this week on two counts of rape and two counts of sexual grooming involving learners at a local school, with the State opposing his release on bail.

The National Prosecuting Authority says the alleged offences date back to 2022. The accused, whose identity is being withheld to protect the child complainants from secondary victimisation, remains in custody. The matter was postponed to 23 September 2026 so that he can obtain legal representation and so that police investigations can continue.

As IOL reported on 17 September, the man is a Kenyan national. That detail is part of the record, and it is where our reporting of the case begins and ends on the question of who he is. What matters before the court is the conduct alleged against him, the evidence the State says it holds, and the protection of the children involved.

What the NPA says happened

NPA regional spokesperson Mashudu Malabi said the accused allegedly recruited learners from a local school and took them to a rented room in Groblersdal.

Malabi said the man allegedly filmed the children while they were naked and gave them money before compelling them to perform sexual acts on him. He allegedly used promises of cellphones as an incentive.

According to Malabi, the matter came to light after the victims were allegedly instructed to recruit other learners from the same school, and the information was then disclosed at the school. It was reported to the police, and the accused was arrested.

The NPA said it treats allegations of sexual offences against children as serious and will prioritise the prosecution, taking into account the vulnerability of the complainants.

Why the case is being handled this way

The decision to withhold the accused’s identity is standard practice in matters involving child complainants. Section 154(3) of the Criminal Procedure Act restricts the publication of information that may reveal the identity of a person under 18 who is a complainant or a witness in criminal proceedings. The purpose is to prevent secondary victimisation, which is the harm a child can suffer a second time through publicity, court process or community reaction rather than through the original offence.

The case is also proceeding under the Sexual Offences and Related Matters Act, which created the separate offence of sexual grooming. Grooming covers the process of building trust with a child, or with a person who has control of a child, in order to enable or promote sexual acts. It is charged separately from rape because the conduct is distinct and because it allows the State to place the earlier conduct before the court.

The court the case is in

Groblersdal is a town in the Sekhukhune District of Limpopo, on the R573, with a magistrate’s court that serves a largely rural catchment. Cases of this kind in district courts depend on the quality of the police docket, on forensic and medical evidence, and on the availability of intermediaries who are appointed to stand between a child witness and the accused when a child gives evidence.

The State’s opposition to bail means the accused must satisfy the court that the interests of justice permit his release. In Schedule 6 offences, which include rape, the applicant carries the heavier burden. The court has not yet heard that application.

What happens next

The case returns to the Groblersdal Magistrates’ Court on 23 September 2026, when the accused is expected to have legal representation and the State is expected to update the court on the investigation. He remains in custody until then.
